University City closer to ban of the homeless

A ban of homeless people from University City
advanced significantly yesterday as a City Council
committee fine-tuned an ordinance to keep the
homeless from many of the city's business
districts.

Initially, Councilwoman Jannie Blackwell, who
represents the West Philadelphia neighborhood, had
her entire district pulled from the "sidewalk
behavior" bill, passed by Council last spring. But
angry residents pressured her to include
University City in the legislation, which bans
sitting or lying on public sidewalks in business
areas.

After polling hundreds of constituents, she said,
she decided to follow the will of the people, who
did not want the homeless walking from Center City
to their neighborhoods. But, she said, she still
considers the bill "the most anti-American bill I
have ever seen."

Councilman Richard Mariano took the opposite
approach. He got a bill released from committee
yesterday that bans people from sitting or lying
on sidewalks anywhere in his district, which runs
through parts of North Philadelphia to the
Northeast.

"I'm afraid if they leave [ Center City ] , they
will move up to Kensington and Frankford," Mariano
said.

The Committee of the Whole also released Mariano's
bill to allow the distribution of handbills in the
city. The original sidewalk-behavior bill banned
giving out handbills, which Mariano, former
Councilwoman Happy Fernandez and the American
Civil Liberties Union all said violated the right
to free speech.

The bills moved without opposition, and it is
likely that Council will give them final approval
before the end of the month.
