Citizens Group Seeking Public Hearings
in the RHappy JohnS Dine Killing

On December 8 Monday at 5:00 PM at City Hall, Santa Cruzans for Full 
Disclosure  will hold a press conference calling for an independent 
investigation and full public hearings  into the November 12th shooting 
death of  RHappyS John Dine by SCPD Officer Conner Carey.
Concerned community members will then present complaints and speak to the 
CPRB at 5:30.

At 5:30 PM, Santa Cruzans for Full Disclosure  
	(1) will publicly present citizen complaints about officer 
conduct in the Dine killing and ask the Citizens Police Review Board  
[CPRB] to schedule immediate public hearings on them. 
	(2)  ask them to seek funding from City Council for an 
independent investigation.
	(3)  petition the CPRB, the Police Department, Mayor Celia Scott, 
and the City Council to secure the release of the police reports involved 
in this case and the subsequent Internal Affairs investigation.
	(4)  petition the County Board of Supervisors and Supervisor 
Mardi Wormhoudt to secure release of the District AttorneyUs 
investigation. 

On December 9 Tuesday at 7 PM at City Council Chambers, Santa Cruzans for 
Full Disclosure, will petition Mayor Celia Scott and City Council to take 
emergency action to fund an independent investigation,  and to secure 
release of all relevant investigative documents--to be set up for public 
view in the public library. 
   The same evening Channel 71 will air RThe Killing of Happy JohnS at 7 
PM  on Club Cruz.

Background
	The Santa Cruz Police Department  and the District AttorneyUs 
Office  investigations which found that killing RjustifiableS took less 
than 8 days: its conclusions matched those issued less than 16 hours 
after the killing.	
	Eyewitness testimony of Stacey Buckelew, Mike Schultz, Tom 
Murphy, Larry Reddick, and Alani Balawejder and as many as 10 other 
eyewitnesses was discounted or ignored in favor of police accounts and 
the story of original complainant who called and then  rode along with 
the police, Ben Newman. Newman was reportedly a friend of CareyUs, and 
has refused to speak openly to the media about his testimony.  	
	All these non-police associated witnesses seem to agree:
		1)  Happy John was not threatening the police.
		2)  Happy John had nothing in his hands above the waist.
		3)  He did not point a gun (or anything else) at the officers.
	Carey, Over, and Newman must be considered less disinterested 
than the five unrelated, uninvolved bystanders--whose testimony sharply 
contradicts the Official Story released by Belcher, Danner, and the Sentinel.

their own COPWATCH--a non-governmental group of concerned citizens intent 
on countering police misconduct by establishing a presence & making a 
record. Patrolling the streets with scanners and video cameras COPWATCH 
documented police misconduct & published their observations.  Santa 
CruzUs 1992-3 COPWATCH worked with Food Not Bombs, the Santa Cruz Union 
of the Homeless, and the Serf City Banner.  The John Dine killing  has 
alerted activists  to the pressing need to reactivate COPWATCH.

%%%%%%  The current Citizens Police Review Board  has been unwilling to 
challenge the current police/City Council/merchant gentrification War on 
the Poor downtown.   In a town with an anti-homeless Sleeping Ban (and no 
legal place for most people to sleep) and a new nighttime Youth Curfew, 
police are rousting, ID-ing, illegally searching, ticketing, and 
brutalizing the street community, the homeless people, teenagers, and 
activists.  Street musicians are driven out from under store awnings into 
the rain & petty drug busts become excuses to RconfiscateS money as 
RevidenceS.

to hold public hearings, declined to call for independent 
investigations,  shied away from making important policy statements, 
overturned virtually every complaint from a homeless person,  & saw its 
most powerful members resign in disgust.  It has rubberstamped  a policy 
of lawlessness by Police Chief Belcher--his 1995 violation & rewriting of 
the C-7 Directive, allowing the police to withhold & reclassify 
complaints.  Now the CPRB refuses to call an emergency meeting in the 
John Dine slaying.

%%%%%%  Virtually every non-police witness has said RHappy JohnS Dine had 
nothing in his hands, pointed nothing at the police, and engaged in no 
threatening behavior when he was shot down by police on November 12th.  
The District Attorney and Police Chief have both closed the case, their 
substantive conclusions unchanged from the conclusions reached within 15 
hours after the shooting (that Dine drew and pointed what looked like a 
weapon at the police).  The Santa Cruz County Sentinel  appears to have 
actively suppressed letters about the case and acted as a police 
propaganda organ in its news columns, ignoring or marginalizing 
contradictions and discrepancies.  The final reports of the police 
internal affairs investigation and the district attorneyUs homicide 
investigation remain behind closed doors.
