WHITE PLAINS - A homeless man, accused of starting a street brawl that =
led to the shooting death of off-duty Mount Vernon Police Officer =
Christopher Ridley, has been offered immunity to a felony weapon charge =
if he testifies before a grand jury convened in the case.

Assistant Westchester County District Attorney Patricia Murphy made the =
offer yesterday in White Plains City Court, after announcing that the =
same grand jury had voted earlier in the day to indict Anthony Jacobs, =
39, on a felony charge of second-degree assault in the Jan. 25 incident.



Murphy said Jacobs would be given immunity from a second felony - =
second-degree criminal possession of a weapon - if he appeared before =
the grand jury on March 4. The weapon charge stems from accusations that =
Jacobs grabbed Ridley's 9 mm handgun when the 23-year-old officer tried =
to arrest him after seeing him beat a 59-year-old Bronx man in downtown =
White Plains.

Ridley, who did not have his badge, managed to retrieve his weapon after =
it fired and fell to the ground in front of 85 Court St. during his =
struggle with Jacobs. He was killed moments later when four county =
police officers converged on the scene and opened fire.

The incident is being investigated by the District Attorney's Office and =
White Plains police.

"The grand jury will be provided with all of the facts and circumstances =
in the death of Officer Christopher Ridley,'' Murphy said, speaking at =
Jacob's appearance in City Court.

Jacobs' grand jury testimony could be key in determining exactly what =
happened when Ridley was killed. Witnesses have said that the officers =
yelled for Ridley to freeze and drop his gun, but that he might not have =
heard them over the din of afternoon rush-hour traffic.

The county policemen - Detective Robert Martin and Officers Frank =
Oliveri, Christian Gutierrez and Jose Calero - have not given statements =
to police. All have retained lawyers.

Jacobs, a convicted burglar who lives at a county shelter in Valhalla, =
was in court for a felony hearing that was canceled after Murphy =
announced that the grand jury had voted to indict him on the assault =
charge. The man, who police said was on his way home from work when he =
was attacked, suffered two broken wrists and bruises. His identity has =
not been made public.

During yesterday's proceeding, City Judge Barbara Leak said she would =
not sign a subpoena submitted by defense lawyer Arlene Popkin demanding =
that prosecutors provide her with a copy of a surveillance video that =
purportedly shows the sequence of events that ended with Ridley's death. =
The video clip was shown to Mount Vernon Police Commissioner David Chong =
and members of Ridley's family last week.

Popkin also asked when her client would be arraigned on the assault =
indictment and when the identity of the attack victim would be revealed =
to her.

"We will not rush this investigation,'' Murphy said, telling the judge =
that authorities will be providing evidence to the grand jury for =
several more weeks.

Leak adjourned the case, scheduling Jacobs' next court appearance for =
March 14.

Popkin did not say whether Jacobs would agree to appear before the grand =
jury and did not speak with reporters after the 10-minute court =
appearance.
