No Attempted Murder Trial For 'Bumfights' Mimic
(CBS) LOS ANGELES A man convicted of assault for beating two homeless =
men with baseball bats after watching a "Bumfights" video last summer =
won't be retried on an attempted murder charge, prosecutors announced =
Tuesday.=20

Justin Edward Brumfield, 20, of Los Angeles, was ordered to undergo a =
90-day diagnostic examination by state prison officials before his Oct. =
30 sentencing date.=20

Brumfield, who faces a maximum of 11 years in prison, was convicted July =
19 of two counts of assault stemming from the attacks last Aug. 16 on =
Ernest Adams and Gerald McHenry.=20

Adams, who was a fixture at the Third Street tunnel, lived on the =
streets for 19 years until the beating, which left him in a coma for 21 =
days and resulted in him losing sight in his left eye.=20

McHenry was attacked as he lay sleeping on the corner of Ninth and Wall =
streets in downtown Los Angeles. He suffered swelling in his left =
forearm.=20

While finding Brumfield guilty of the assault charges, jurors could not =
reach a verdict on the most serious charge against him, the attempted =
murder of Adams. The panel deadlocked 3-9 in favor of acquitting =
Brumfield on that count.=20

Brumfield's friend, William Alexander Orantes, also now 20, is facing =
trial Aug. 9.=20

The two were arrested shortly after the attacks.=20

On the stand, Brumfield admitted committing the assaults, but maintained =
that he never intended nor premeditated the beatings.=20

Defense attorney Maynard Davis said the attacks culminated a series of =
breakdowns in which Brumfield tried to commit suicide after discovering =
that his biological mother was a homeless crack cocaine addict.=20

He said the "Bumfights" videos, featuring homeless men who were paid to =
fight each other and perform dangerous stunts, only contributed to "the =
manner in which" the attacks occurred.=20

The real reason behind the attacks, the lawyer contended, was the trauma =
that Brumfield, who was adopted, went through when he found out about =
his mother's background.=20

"His whole demeanor changed when he found that out," Davis said last =
month. "He's a very depressed young man."=20
