Judge: Homeless shelter does not violate Hollywood's zoning laws

Hollywood -- The homeless shelter on Federal Highway does not violate the
city's zoning laws; the city's politicians just didn't want the shelter and
were looking for a way to shut it down.

That's what Broward Circuit Court Judge Victor Tobin ruled Friday, in
response to the city's lawsuit against wealthy activist Sean Cononie and his
shelter at 1203 N. Federal Hwy.



Testimony at trial early last month "showed that the commissioners have
expressed their opinion that they do not want the Foundation in the City of
Hollywood," Tobin wrote.

The city argued that Cononie and his nonprofit Cosac Foundation were
performing medical, mental health and other services at the shelter in
violation of city zoning laws. City lawyers admitted that if Cononie simply
operated the shelter as a hotel without offering the people counseling, he
could stay open.

"I think they knew I wouldn't" want to be a flophouse, Cononie said. "They
knew I wanted to give people services."

Cononie has been fighting with city officials since he opened his first
shelter at the Jo-Lin Apartments on Lincoln Street in 1997. In 2002, in
moved to his current building, which houses about 150 people nightly.

Tobin ruled that the city commission's effort to move the shelter from
Federal Highway to an industrial area was "arbitrary and capricious."

The places where the city said the shelter would be appropriate "are in an
area where residential and institutional uses are prohibited" by the city's
zoning laws, Tobin said. "These prohibited uses are the exact reasons why
the Foundation exists."

City Attorney Dan Abbott said he was disappointed in the judge's ruling and
disputed the fact that the city was trying to run Cononie's shelter out of
town.

Abbott said he would talk with the City Commission to see if they wanted to
appeal the decision.
