TB Inquest Day One - Disturbing beginning.

 

Monday November 17th

 

This is the first of what we expect to be daily updates from 
the Coroner's Inquest into the death of a homeless man,  Joseph 
Teigesser, from tuberculosis. We will, each day, be providing highlights 
on what occurred in the inquest on that day and what is expected the 
following day.

 

Coroner's Court is at 15 Grosvenor Street (runs east-west, between Bay 
and Yonge and north of College).

 

The inquest is expected to run from Monday to Friday for approximately 
3-4 weeks from 9:30 to late afternoon. Each day a lunch will be provided 
because we do expect and hope that homeless people will attend. Please 
consider joining us for an hour or two whenever you can. This is an 
important event this winter that could impact on the homeless population 
and on you and your work.

REPORT ON DAY ONE OF THE TB INQUEST (Monday November 14th 2003): 

 

A tuberculosis outbreak that began in 2001 in the homeless population in 
Toronto resulted in 15 known, DNA linked cases of active tuberculosis 
and three deaths. Community concern resulted in an inquest which began 
today into the death of one of the men named Joseph Teigesser who died 
from tuberculosis in 2001.

 

The Tuberculosis Action Group (T-BAG), which includes a number of health 
and social service agencies, and Aboriginal Legal Services (representing 
three aboriginal organizations) have standing at the inquest.

 

Lawyers Peter Rosenthal and Kim Murray representing the above 
organizations respectively argued unsuccessfully today that the jury 
should be asked a question by Dr. Edwards, the presiding coroner, to 
determine any bias with respect to aboriginal or homeless people. The 
lawyers argued that it is widely recognized that bias and prejudice does 
exist in the community at large on these issues, that there are court 
precedents for juries being asked such questions and that bias could 
impact on jury recommendations. Sadly, the coroner rejected this submission.

 

Lawyers, members of the media and community workers were surprised at 
the heavy security this morning at coroner's court. Bags were searched,  
people's bodies checked with a wand creating anxiety and a backlog to 
get into the courtroom.  Peter Rosenthal asked why this was suddenly 
occurring and who made the decision and appealed to the coroner to 
reverse the decision. As it turns out these extreme measures were put in 
place by a detective only a few weeks ago in anticipation of this 
inquest . The coroner ruled to uphold the police officer's decision.

 

What to expect on Day 2:

 

In the morning Dr. Andrew Simor will provide a "TB 101"  to the jury and 
in the afternoon various doctors who treated the deceased will testify.
