Homeless plaintiffs sue to halt Care Not Cash

Opponents of the voter-approved Care Not Cash initiative sued in Superior
Court on Monday to stop the imperiled welfare reform measure from taking
effect. 

Two homeless plaintiffs, represented by the Lawyers Committee for Civil
Rights and Bay Area Legal Aid, argue that the backers of Care Not Cash
cannot guarantee their promise to voters that services would be provided to
homeless people on city welfare.

City voters approved the Care Not Cash initiative in November with nearly 60
percent support. The measure would cut cash aid for homeless people
participating in county-funded welfare programs and offer them services
instead. The cash stipend would not be reduced if the services weren't
available. 

But in May, Superior Court Judge Ronald Quidachay invalidated key provisions
of Care Not Cash, ruling that only city officials, not voters, could set
welfare standards. The city attorney has appealed the ruling.

Care Not Cash, which was to take effect today, has been put on hold. The new
lawsuit seeks to invalidate the entire measure.

Meanwhile, Supervisor Gavin Newsom, who sponsored the initiative,
reintroduced the measure to the Board of Supervisors for consideration later
this month.
