CIRCULATE PLEASE to nonviolent defenders of Homeless People's Civil Rights Santa Cruz CA USA bars HOMELESS ACTIVISTS - COURT DATE Jan 10 Wed FWD - REPLY TO: "Becky Johnson of HUFF" <wmnofstl@cruzio.com> Homeless United for Friendship & Freedom 309 Cedar St. PMB 14B Santa Cruz, Ca. USA 95060 (831) 423-HUFF fax (831) 429-8529 e-mail Wmnofstl@cruzio.com FOR IMMEDIATE RELEASE: Sunday, January 7, 2001 KOFFEE KLATCHERS GO TO COURT Face Charges of "Occupying Furniture", "Making Public Document Requests", & "Trying to Pay for Copies with a $20 Bill"! Barred From Council Meetings Tuesday Santa Cruz, Ca. - HUFF homeless activists will field questions Wednesday, January 10th at an 8:00 AM press conference in front of the Santa Cruz County Courthouse. At 8:30 AM, they will go before Dept. 7 Judge Samuel Stevens. Robert Norse, Becky Johnson, and Bernard Klitzner face a (possible 3-year) permanent injunction, orchestrated by the Mayor's office, alleging harassment of Administrative Assistant, Anna Brooks during a 17 day lobbying period by members of the City Hall Koffee Klatch and Tag-Team Teach-in asking an end to the Sleeping Ban & Blanket Ban sections of the Camping Law. The Klatch Teach-In was so-named because it included free coffee & hoped through one-on-one contacts to educate Council members about the urgency of restoring self-sheltering survival rights to homeless people in Santa Cruz. Said Johnson, "The Council now has the necessary majority to repeal the Sleeping Ban, set up safe sleeping zones, or significantly increase shelter. Yet there is nothing on the January 9th agenda and Mayor Fitzmaurice is still worrying about "losing favor among his supporters". Apparently 41 homeless deaths and emergency shelter for less than 160 of more than 1500 homeless in Santa Cruz can't move the Mayor or his Council to any action." Currently the three activists are barred from being anywhere within 150 feet (the length of half a football field) from the City Council Offices (Room 10) at 809 Center St. The 21-page order excludes them from the entire City Hall complex, driving past it, attending City Council meetings, and even being in front of the Civic Auditorium. It makes no allegations of violence, threats of violence, or any allegation of criminal activity more serious than "helping themselves to office supplies" referring to the pen and memo pad left on the counter for public use. "We're fighting this injunction as a S.L.A.P.P. suit. That's a Strategic Lawsuit Against Public Participation which has the effect of violating first amendment rights." Said David Beauvais, a Berkeley lawyer, who has experience with the People's Park S.L.A.P.P. suit. "This order was improperly issued without a hearing in the 1st place & seems part of a continuing pattern of harassing unpopular activists." Pizza will be served at the 8 AM Press Conference on the steps of the Courthouse at 701 Ocean St. on January 10th The Hearing to Restore Civil Rights to the Koffee Klatch Three Will Begin in Dept. 7 at 8:30 AM.
