(AP) _ Occupants of a Pontiac homeless shelter are suing the city and its police department for depriving them of their constitutional rights during a raid last month. The suit accuses Pontiac Police of using excessive force and arresting people who had committed no crime when the Grace Centers of Hope was raided Jan. 23. It also accuses an officer of handcuffing a 6-year-old. The suit was filed Monday in U.S. District Court in Detroit. It names the city, police department, Police Chief Larry Miracle and unidentified police officers as defendants and seeks more than $75,000 in total dam- ages. The suit was filed by attorney Judith Gracey on behalf of Arthur Haggerty, Michael Kotz and Betty Conyers and her 6-year-old son. The city had no comment on the lawsuit. Katrina Henry, spokeswoman for Pontiac Mayor Walter Moore, told the Detroit Free Press that the city does not discuss pending litigation. Miracle didn't comment Monday afternoon. But he has denied the allegation that a child was handcuffed, instead saying a police officer allowed children to play with her handcuffs. Police said they arrested 32 shelter residents in the 5 a.m. raid. They said all but one had outstanding misdemeanor warrants. Shelter residents protested the raid last week and the center's director, the Rev. Kent Clark, said a building code inspection last week amounted to harassment. ``These individuals have a right to seek redress for these actions,'' Gracey told The Oakland Press. ``But that is separate from the overall right of this facility to function.''
